Terms of service
These terms govern every purchase made in the FitPal Store at fitpal.store. They are written in line with the Slovenian Consumer Protection Act (Zakon o varstvu potrošnikov, ZVPot-1) and the Electronic Commerce Market Act (Zakon o elektronskem poslovanju na trgu, ZEPT). By placing an order you confirm that you have read them and agree to them.
1. The seller
The online shop at fitpal.store is operated by EV Projects, Projektiranje, Egon Vrbančič s.p., Ulica Jožeta Pučnika 2, 2325 Njiverce, 2325 Kidričevo, Slovenia. Owner and manager: Egon Vrbančič. Company registration number (matična številka) 9651985000, tax number (davčna številka) 96432764, entered in the Slovenian business register on 30 April 2024. Contact: hello@fitpal.store.
The seller is not registered for VAT. VAT is not charged on the basis of Article 94 of the Slovenian Value Added Tax Act (DDV ni obračunan na podlagi 94. člena ZDDV-1). Because the shop sells digital files only, there is no retail location to visit and email is the way to reach us; we reply within 1–2 business days.
2. What we sell
We sell digital products: meal plans, recipe books, planners and guides, supplied as PDF files. Each product page states what the product contains and how many pages it has. No physical goods are shipped, so there are no shipping costs, delivery times or customs charges. Product photographs and mockups illustrate the contents of the files; they are not physical items. Where a product is offered in omnivore, vegetarian and vegan versions, you choose the version at checkout and receive only the version you chose.
3. How a contract is concluded
You select a product and add it to the cart; you open the cart and check what it contains, where you can change the quantity or remove an item; you enter your email address and billing details and choose a payment method; the checkout shows a summary of the order and the total price before you confirm. Your order is a binding offer, and the contract is concluded when we confirm it by email and make the download available.
4. Correcting mistakes before you order
You can identify and correct input errors at any point before the order is placed: in the cart you can change quantities or remove items, in the checkout you can go back and correct your email address and billing details, and the order summary shown before the final confirmation lets you check everything once more. After the order is placed, write to hello@fitpal.store and we will correct what can still be corrected.
5. Storage of the contract
We store the record of every concluded contract. You receive a copy with your order confirmation email, and you may request a further copy in electronic form at any time by writing to us. These terms are published on this page and can be saved or printed at any time.
6. Prices
All prices are shown in euros (EUR) and include any applicable taxes, so the price you see is the final price. The seller is not registered for VAT, so no VAT is added at checkout, and there are no delivery charges because nothing is posted. Prices may change at any time, but a change never affects an order that has already been placed and paid for. Special offers apply until the stated date or until withdrawn, and discounts are not combined unless the offer says otherwise.
7. Payment
Payment is handled by our payment providers. We never see or store your full card details. Once a payment is approved, the order is confirmed and the download is released.
8. Delivery of digital products
After your payment is approved, the download link appears on the order confirmation page and is sent to your email address, usually within a minute. Bundles and the recipe books arrive as a single ZIP file containing the PDFs. If the email does not arrive, check your spam or promotions folder first, then write to us with the name you used at checkout and we will deliver the files another way.
9. Right of withdrawal
As a consumer in the EU you normally have 14 days to withdraw from a distance contract. For digital content supplied immediately and not on a physical medium, that right ends once the download begins, provided you have given your express prior consent and acknowledged that you lose the right of withdrawal. You give this consent at checkout, which is why a completed purchase cannot be cancelled or returned once the file has been made available to you. If you have not yet downloaded the files and you write to us within 14 days, we will cancel the order and refund you in full.
10. Refunds and complaints
If something is wrong on our side — the download link does not work, the file is damaged or will not open, you received a different product, the product clearly does not match its description, or you were charged twice — write to hello@fitpal.store within 14 days and we will repair it or refund you in full. Full details are in our refund policy. We confirm receipt of every complaint within 1–2 business days and aim to resolve it within 8 days. Approved refunds are returned to your original payment method within 14 days.
11. Conformity of digital content
We are liable for the conformity of the digital content with the contract under Slovenian and EU law. If the content supplied does not conform, you may request that it be brought into conformity, a price reduction, or termination of the contract, under the conditions set by law. Nothing in these terms limits those statutory rights.
12. How you may use the files
When you buy a product you receive a personal, non-transferable licence to use it. You may download it, keep it on your devices and print it as many times as you like for your own household. You may not resell, rent out, share, publish or distribute the files, upload them to public or shared services, or use them commercially, for example as coaching materials, courses or printed products for sale. All copyright in the text, design and products remains with the seller.
13. Health disclaimer
FitPal products contain general wellness information. They are not medical advice, not a treatment plan and not personalised nutrition advice, and they do not replace a consultation with a doctor or a registered dietitian. Please seek professional advice before changing your diet or starting to exercise, especially if you are pregnant or breastfeeding, under 18, taking medication, or living with a health condition. Calories and protein are calculated ingredient by ingredient from standard nutrition data and shift with brands and preparation, so treat them as close estimates.
14. Liability
We prepare our content carefully and check the nutritional calculations, but to the extent permitted by law our liability is limited to the price you paid for the product. Nothing in these terms limits liability for intent or gross negligence, for death or personal injury, or your statutory consumer rights. We are not liable for interruptions caused by circumstances outside our control, such as a failure at a payment, email or hosting provider, but we will always deliver your files another way if a technical problem prevents normal delivery.
15. Personal data
We process personal data in accordance with the GDPR and Slovenian data protection law, and only to the extent needed to complete your order, deliver your files, answer your questions and, where you have agreed to it, send you email marketing you can unsubscribe from at any time. Details are in our privacy policy.
16. Out-of-court dispute resolution
We do our best to resolve any complaint directly. In accordance with Slovenian consumer protection law, we do not recognise any provider of out-of-court consumer dispute resolution as competent for disputes arising from our online sales. You may still contact the Slovenian Market Inspectorate (Tržni inšpektorat RS) or a consumer organisation for assistance.
17. Changes to these terms
We may update these terms for operational, legal or regulatory reasons. The version published on this page at the moment you place your order is the version that applies to that order.
18. Governing law
Slovenian law applies, without affecting the mandatory consumer protection rules of the country in which you live. Disputes that cannot be resolved by agreement fall under the jurisdiction of the competent court in Slovenia.
